The durable power of attorney allows a principal to appoint an agent to administer nearly all of their affairs should they become incapacitated or unable to do so on their own. This can include managing matters related to real and personal properties, securities, financial institution relationships, business operations, estates and trusts, claims and litigation, personal and family matters, retirement plans, tax matters and just about any other life necessity.
The medical power of attorney designates a “health care agent” to act on behalf of the principal when it comes to making medical decisions. It remains in effect indefinitely unless a specified termination date is designated on the legal form. The agent can only make these decisions on behalf of the principal if the attending doctor certifies that the principal is unable to do so.
