What is a registered agent?

Also known as a resident agent, statutory agent, or agent for service of process, a registered agent is the person or entity designated by a business to receive legal and government correspondence

All businesses are required to name their registered agent during the business formation process.

What are the requirements?

A registered agent must be an adult or a business that offers registered agent services and meet the following requirements:

  • Must always be physically present at their designated address during all normal business hours to receive correspondence
  • Must be a resident and have a street address in the state where the business is formed

Failure to meet the state’s requirements for registered agents can result in severe fines and legal problems.

Who can be a registered agent?

A business cannot be its own registered agent, but a person affiliated with the business can become the registered agent for the business.

Third-party companies are preferred since they need to be available during business hours. This leaves you, the business owner, able to take vacations, schedule downtime, or leave the office early. You can do so with confidence, knowing there is someone else that can be contacted if a governing body needs information or assistance.
