Designate the Principal and Agent

Provide the name and address of the agent, and the name of the principal who executed the power of attorney. The state and date of creation of the power of attorney must also be provided so that the original document is clearly referenced and any confusion is avoided.

Set the date on which the resignation becomes effective so that the principal, any successor or co-agents, or other interested third parties may smoothly continue to manage the principal's affairs. Set forth all interested parties who should be receiving notice of the agent resignation. This includes the principal, conservator, guardian, co-agents, successor agents, a governmental agency with authority to protect the principal’s welfare, and any other persons that the agent reasonably believes has an interest in the principal's welfare.

Review and Sign

Thoroughly review the document for accuracy and completeness, and ensure that all relevant and known third parties are included. Finalize the resignation with the agent's signature. It is good practice, as with any formal document, to have the signature notarized, and to deliver the resignation notice to the appropriate parties through certified mail.
